Terms of Service for CyberGrizzly Care Effective Date: April 9, 2026 Welcome to CyberGrizzly Care. These Terms of Service (“Terms”) constitute a legally binding agreement between you and Cyber Grizzly Corporation (“Company,” “we,” “us,” or “our”) governing your use of the CyberGrizzly Care application (“App”) and any associated services. 1. Description of Service CyberGrizzly Care provides an AI-powered companion and wellness check-in platform designed to facilitate social engagement and communication between seniors, their families, and their designated caregivers. 2. Medical & Emergency Services Disclaimer IMPORTANT: PLEASE READ CAREFULLY • Not a Medical Device: The App is a wellness and social tool. It is NOT a medical device, nor is it a replacement for professional medical advice, diagnosis, treatment, or clinical supervision. • 911 & Emergency Functionality: The App’s "Emergency" button acts solely as a shortcut to trigger your device's native phone dialer. Cyber Grizzly Corporation does not monitor these calls, does not guarantee connection to emergency dispatchers, and is not responsible for cellular service failures or hardware malfunctions during an emergency. • No Clinical Monitoring: The Company does not provide live monitoring of health data or AI conversations by medical professionals. 3. AI Content & Interaction The App utilizes Artificial Intelligence (via Google Gemini). • Accuracy: AI may occasionally generate inaccurate, biased, or "hallucinated" information. • Assumption of Risk: Users and caregivers should independently verify any information provided by the AI. The Company is not liable for actions taken based on AI-generated suggestions. 4. Accounts and Security To use the App, you must register for an account. • Security: You are responsible for maintaining the confidentiality of your login credentials. • Unauthorized Use: You must notify us immediately at support@cybergrizzlycare.com of any unauthorized access to your account. • Age & Consent: Users under the age of 18 (or the age of majority in their jurisdiction) may only use the App with the express permission and supervision of a parent or legal guardian. By allowing a minor to use the App, the parent or guardian agrees to be bound by these Terms. 5. Subscriptions, Payments, and Billing All financial transactions are processed securely via Stripe. • Pricing: Subscriptions are currently offered at $49.99/month or $129.99/quarter. Prices are subject to change with prior notice. • Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled. • Cancellations: You may cancel your subscription at any time via the App settings or your app store portal. • Refund Policy: To the extent permitted by law, payments are non-refundable. No partial refunds or credits are issued for unused portions of a billing period. 6. Privacy and Data Handling Your privacy is paramount. By using the App, you agree to our collection and use of data as outlined in our Privacy Policy. • Wellness Data: We collect check-in data to share with designated caregivers. • Minors: We do not knowingly collect personal information from children without parental consent. If we learn we have collected personal information from a child without proper authorization, we will delete that information immediately. • HIPAA Statement: While we employ industry-standard security, CyberGrizzly Care is a consumer wellness tool and is not intended for the storage of protected health information (PHI) under HIPAA unless otherwise stated in a separate Business Associate Agreement (BAA). 7. Prohibited Conduct You agree not to: • Use the App for any illegal or unauthorized purpose. • Attempt to reverse-engineer, decompile, or disrupt the App’s infrastructure. • Use the AI companion to generate harmful, harassing, or defamatory content. 8. Limitation of Liability To the maximum extent permitted by applicable law, Cyber Grizzly Corporation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: • Personal injury or medical emergencies. • Loss of profits, data, or use. • Any conduct or content of any third party on the service. 9. Changes to Terms We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or an in-app notification. Your continued use of the App after changes are posted constitutes acceptance of the new Terms. 10.
